Attorneys for C'Aundre Douglas filed a motion to suppress the 12-minute interview in May. Douglas, 21, was arrested the day after prosecutors allege he shot and killed 20-year-old Elijah Hughes outside Hughes' south Fargo apartment building, in retribution for the fatal shooting of Azeem Holmes outside a downtown nightclub a half hour earlier. Jayvon Allen was arrested and charged with Holmes' death this summer. At the hearing to consider the suppression request Tuesday, Oct. 20, Douglas' attorney Samuel Gereszek said his client reiterated his desire to have an attorney present multiple times during the interview but Detective Josh Loos kept discussing the case, and "making statements that are designed to elicit an incriminating response
